PRIVACY POLICY

Nicolai Bergmann K.K. (hereinafter referred to as “the Company”) establishes the following privacy policy (hereinafter, “this Policy”) regarding the handling of personal information of customers using the services provided by the Company (hereinafter, “the Services”).

Article 1 (Definition of Personal Information)

“Personal Information” refers to information defined as such in Article 2, Paragraph 1 of the Act on the Protection of Personal Information.

Article 2 (Method of Collection and Items Collected)

The Company may ask customers to provide personal information such as name, gender, date of birth, address, phone number, email address, bank account number, credit card number, driver’s license number, preferred store location, and areas of interest. Additionally, transaction records and payment information from affiliated partners (including information providers, advertisers, and ad delivery platforms; hereinafter referred to as “Partners”) may also be collected.

Article 3 (Purpose of Use)

The Company collects and uses personal information for the following purposes:

  • To provide and operate the Services.
  • To deliver products, provide services, and after-sales support.
  • For product and service improvement, and for planning, researching, and developing new offerings.
  • To respond to customer inquiries (including identity verification).
  • To inform customers of new features, updates, campaigns, and related products and services.
  • To analyze and research marketing data, and implement related strategies.
  • To contact customers with important notices or for maintenance purposes.
  • To identify and restrict users who violate terms or misuse the Services.
  • To allow customers to view, modify, or delete their registration details or usage history.
  • To invoice customers for paid services.
  • For purposes incidental to the above uses.

Article 4 (Changes to Purpose of Use)

The Company may change the purpose of use, provided that the new purpose remains reasonably related to the original. Any changes will be notified or published via appropriate channels.

Article 5 (Provision to Third Parties)

  1. The Company will not provide personal information to third parties without prior consent, except in the following cases or as permitted by law:
     - When necessary to protect life, body, or property, and obtaining consent is difficult.
     - When essential for public health or child development, and obtaining consent is difficult.
     - When cooperating with national or local governments, and obtaining consent could hinder the execution of official duties.
  2. The following cases are not considered “provision to third parties”:
    – When outsourcing handling of personal information to fulfill the stated purpose of use.
    – When transferring due to merger or business succession.
    – When sharing use with specific parties, provided the items of information, shared parties, purpose of use, and managing party are made known to the individual or made easily accessible.
  3. The Company may aggregate personal information into anonymized statistics to improve quality but will not share this data with third parties.
  4. The Company may use personal information to analyze ad effectiveness, user interests, and behavior. In some cases, hashed (non-identifiable) data may be provided to advertising and analytics partners. These partners may cross-reference it with their own data (e.g., SNS account info) to identify user preferences.

Article 6 (Shared Use)

  1. The Company may share personal information provided by customers:

   (1) Purpose of Shared Use: As stated in Article 3.

   (2) Information Shared: As defined in Article 2.

   2. The Company may also provide browsing or behavioral data (“related personal information”) to third parties. These parties may link it with their own data for analysis.

Article 7 (Disclosure of Personal Information)

The Company will disclose personal information upon request from the individual, unless:

  • It poses risk to life, body, property, or rights.
  • It significantly hinders Company operations.
  • It violates other laws or regulations.

Non-personal information will not be disclosed as a general rule.

Article 8 (Correction and Deletion)

Customers may request correction, addition, or deletion (collectively, “Correction”) of their personal information if inaccurate. Requests must be sent via email to: onlineshop@nicolaibergmann.com, clearly specifying the information to be corrected. The Company will review and act on the request if deemed necessary. Customers will be informed of the outcome (Correction or denial) without delay. A fee of ¥1,000 per request will be charged.

Article 9 (Suspension of Use, etc.)

If personal information is being used beyond its intended purpose or obtained improperly, customers may request suspension or deletion of use (“Suspension”).
The Company will act on such requests if warranted. Customers will be informed of the outcome (Suspension or denial) without delay.
If Suspension is too costly or difficult, the Company may take alternative measures to protect the customer’s rights. A fee of ¥1,000 per request will be charged.

Article 10 (Security Measures)

The Company takes reasonable and necessary measures to prevent unauthorized access, loss, leakage, or tampering of personal information. For more details, please contact the inquiry desk outlined in Article 12.

Article 11 (Changes to Policy)

Unless otherwise specified, this Policy may be changed without prior notice.
Any changes become effective when posted on the Company’s website.
